AGREEMENT TO TERMS AND CONDITIONS

1. DEFINITIONSIn this Agreement, "MotorCity Casino Hotel" refers to MotorCity Casino Hotel and its affiliates.

2. USE OF WEBSITE AND MOBILE APPLICATIONBy accessing the MotorCity Casino Hotel website or mobile application (collectively referred to as the "Platform"), you acknowledge that you have read, understand, and agree to be bound by these Terms and Conditions ("Agreement"). This Agreement governs your use of the Platform, including any promotions, offers, and services provided through it.

3. ELIGIBILITYThe Platform is intended for use only by individuals who are at least 21 years old or older, as required by law in Michigan. MotorCity Casino Hotel reserves the right to request proof of age from users and may terminate your account if you do not meet this requirement.

4. GAMING PRODUCTS AND SERVICESMotorCity Casino Hotel offers a range of gaming products and services through its casino floor, including slot machines and table games. MotorCity Casino Hotel is regulated by the Michigan Gaming Control Board (MGCB) to ensure fairness and integrity in all gaming activities.

5. RESERVE OF RIGHTSMotorCity Casino Hotel reserves the right, at any time, without notice or liability, to modify, suspend, or discontinue its services and/or products offered through the Platform, including but not limited to the availability of certain games or promotions.

6. LICENSE AND USE RESTRICTIONSThe use of the Platform is restricted to personal, non-commercial purposes only. You may not reproduce, distribute, display, sell, license, or otherwise exploit any content from the Platform for commercial gain without prior written permission from MotorCity Casino Hotel.

7. INTELLECTUAL PROPERTY RIGHTSMotorCity Casino Hotel retains all rights, title, and interest in its intellectual property, including trademarks, trade names, logos, domain names, copyrights, patents, designs, and know-how (collectively referred to as "Intellectual Property"). You acknowledge that the Platform is protected by applicable laws and international treaties.

8. USER RESPONSIBILITIESYou agree to use the Platform responsibly and in compliance with all applicable laws and regulations. You are solely responsible for your actions while using the Platform, including any losses or damages resulting from your own misconduct.

9. WARRANTY DISCLAIMERMotorCity Casino Hotel makes no warranties of any kind, express or implied, regarding the accuracy, completeness, security, timeliness, merchantability, fitness for a particular purpose, and non-infringement of goods, services, information, data, and content provided on or through the Platform.

10. LIMITATION OF LIABILITYMotorCity Casino Hotel shall not be liable to you for any indirect, consequential, special, incidental, punitive, exemplary damages, loss of use, lost profits, business interruption, or other economic losses arising out of your use of the Platform, even if MotorCity Casino Hotel has been advised of such possibilities.

11. DISPUTE RESOLUTIONAny disputes or claims arising from or related to this Agreement shall be resolved through binding arbitration in accordance with the rules and procedures of the American Arbitration Association (AAA).

12. GOVERNING LAW AND JURISDICTIONThese Terms and Conditions are governed by and construed in accordance with the laws of Michigan, without giving effect to any conflict-of-law principles or rules. Any disputes arising out of this Agreement shall be resolved exclusively through the state courts of Michigan.

13. AMENDMENTS TO AGREEMENTMotorCity Casino Hotel reserves the right to modify these Terms and Conditions at any time without prior notice. Your continued use of the Platform after such changes constitute your acceptance of the updated terms and conditions.

14. TERMINATION OF SERVICESMotorCity Casino Hotel may terminate its services or suspend access to the Platform, with or without cause, by providing you written notice. Upon termination, all rights granted hereunder shall immediately cease.

15. NOTICES AND COMMUNICATIONSAll notices and communications made under these Terms and Conditions must be in writing and sent through the postal service or electronic mail addressed to MotorCity Casino Hotel's registered office. You acknowledge that electronic communication will suffice for this purpose, provided it is directed to the designated contact address.

16. ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between you and MotorCity Casino Hotel regarding your use of the Platform, superseding all prior or contemporaneous communications, agreements, and understandings, both written and oral.
